The Model Clause for Mediation, as periodically amended by SARCO, forms an integral part of the Rules of Procedure for Mediation and apply to all mediations after its effective date.

If contracting parties wish to refer disputes to mediation under the SARCO Mediation Rules, we recommend that our Model Mediation Clause be used. Spaces/Words in square brackets should be deleted/completed as appropriate. The SARCO Secretariat will be pleased to discuss any modifications to these standard clauses.

“Where, in the event of a dispute, controversy or claim arising out of or relating to this contract, or the breach, termination, or invalidity thereof, the parties wish to seek an amicable settlement of that dispute by mediation, the mediation shall take place in accordance with the SARCO Rules of Procedure for Mediation as at present in force. Consider adding to model clause:

• The number of mediators shall be _____________ [one/three]
• The place of mediation shall be ______________ [city/country]
• The language to be used in mediation proceeding shall be _________ [language]”
