The Model Clause for Arbitration, as periodically amended by SARCO, forms an integral part of the SARCO Rules of Procedure for Arbitration and apply to all arbitrations after its effective date.
If contracting parties wish to refer disputes to arbitration under the SARCO Rules of Procedure for Arbitration, we recommend that our Model Arbitration Clause be used. Any spaces or words in square brackets [ ] should be deleted or completed as appropriate. The SARCO Secretariat will be pleased to discuss any modifications to these standard clauses.
“Any dispute, controversy or claim arising out of or relating to this contract, or the breach, termination or invalidity thereof, between the parties shall be settled by arbitration in accordance with the SARCO Rules of Procedure for Arbitration as at present in force, and the award made in pursuance thereof shall be binding on the parties.
